Terms for cooks

The Sikook cooks' charter: what you accept when you open your page, and what Sikook commits to do for you.

1. Purpose

These terms, also called the "cooks' charter", govern the relationship between Umnya Hospitality SARLAU ("Sikook") and any person selling on Sikook ("the cook"). You accept them by ticking the box provided when you open or claim your page. The terms of use and sale also apply to your sales.

2. Who can sell

Sikook welcomes homemade Moroccan food: dishes, pastries, catering, local produce (for example amlou, spices, oils, frozen msemen).

  • You make what you sell yourself, or under your direct responsibility within your own business. Reselling industrial products or products bought from third parties is not allowed.
  • You are of legal age and have the capacity to enter into contracts.
  • The information you provide (name, city, contact details, status) is accurate and kept up to date.

3. Your status and compliance with the law

You sell under your own legal status: self-employed, sole trader, local or foreign company. You are the seller of the dishes and solely responsible for:

  • the declarations, registrations and permits required in your country to prepare and sell food (for example registration with the food safety authority or business registration);
  • complying with hygiene and food safety rules, the cold chain and traceability;
  • accurate information on ingredients and the allergens that must be declared under the rules of your country, and on storage;
  • your prices, your invoices where required, and declaring your income and taxes;
  • delivery or pickup, including when you use a courier.

Sikook does not continuously check compliance with these obligations, but may ask you for supporting documents at any time.

4. Your page and your content

You are responsible for the texts, prices, photos and information published on your page. You warrant that you hold the rights to the photos you upload and have the consent of the people shown in them.

You grant Sikook a non-exclusive, free, worldwide licence to reproduce, adapt (cropping, compression) and display this content on the site and to promote your page and Sikook (social media, emails, press), for as long as you are registered and up to six months after that for material already published. You remain the owner of your content.

Sikook may correct the presentation of a page (spelling, category, blurred photo) and remove content that breaches these terms or the law.

5. Orders

You receive orders with the buyer's contact details. You accept or decline them promptly, within 24 hours at the latest, and keep your dishes, availability, areas and delivery fees up to date.

An accepted order must be fulfilled on the agreed date. If you cannot, let the buyer and Sikook know as soon as possible and offer another date or cancellation.

Buyers' contact details may only be used for the order concerned. You do not use them for other purposes (marketing, resale) without their consent.

6. Commission, trial period and subscription

  • The first three months from the opening of your page are commission free.
  • After that, Sikook charges a commission of 20% of the amount of each order, excluding delivery fees: delivery fees go to you in full.
  • A subscription may be offered after the trial period. Its price is announced before your three months end, and you remain free not to take it and to stop.

Any change to the commission or prices is announced at least 30 days in advance; you may then close your page at no cost.

7. Referral

Each cook you refer whose page is opened gives you one free month, up to six months. Free months have no cash value and cannot be transferred or refunded.

8. Payments and payouts

  • Cash on delivery or pickup: the buyer pays you directly. The commission owed to Sikook on these orders is invoiced as follows: a monthly summary invoice, payable by bank transfer within 15 days.
  • Payment by bank transfer, and by card once offered: Sikook collects the payment on your behalf and pays you the order amount, less the commission, to the bank account of your business, as follows: every week, for orders delivered and not disputed during the previous week.

If there is a complaint or dispute about an order paid through Sikook, the corresponding payout may be held while it is reviewed.

9. Cancellations and complaints

If you cancel an accepted order, the buyer is refunded in full and no commission is due. Repeated cancellations may lead to your page being suspended.

You handle buyers' complaints in good faith. Sikook can help find an amicable solution; if a refund is justified for an order paid through Sikook, it is deducted from your payouts.

10. Reviews

Only buyers who have ordered from you can post a review, after moderation by Sikook. You may reply. Posting fake reviews, having them posted, or offering anything in exchange for a review is prohibited.

11. Suspension and removal

Sikook may suspend or remove a page, after informing you and, except in urgent cases, inviting you to explain, in the event of a breach of these terms, a risk to buyers' health, serious or repeated complaints, false information or illegal activity.

12. Pages prepared in your name

Sikook may prepare a private draft page from information you have made public (social media, website). This draft is not published: it only becomes visible if you claim it, complete it and accept these terms.

You can ask for its removal at any time by writing to salam@sikook.com; it is then deleted.

13. Term and termination

These terms apply as long as your page is open. You can close your page at any time by writing to salam@sikook.com; orders already accepted must still be fulfilled and commissions already owed remain payable.

Sikook may end the relationship with 30 days' notice, or without notice in the event of a serious breach.

14. Personal data

Sikook processes your data as described in the privacy policy. For the buyers' data you receive, you act as a separate data controller and ensure its protection and confidentiality.

15. Transfer of the agreement

Sikook is currently operated by Umnya Hospitality SARLAU. You agree that Sikook may transfer these terms, your page, your ongoing orders and the related data to an affiliated company or to a company set up to operate Sikook (for example a dedicated Sikook company), without reducing your rights or your commercial terms. You will be informed by email at least thirty days in advance and remain free to close your page.

16. Liability, governing law and changes

Sikook provides the platform with care but without any guarantee of sales or permanent availability. You indemnify Sikook against any claim related to your dishes, your content or a failure to meet your obligations.

Governing law and competent courts: droit marocain, tribunaux de commerce de Marrakech.

Sikook may update these terms; any significant change is notified to you at least 30 days before it takes effect.
